A man recently lost his life in a tragic motor vehicle crash in California, and another man was injured in the crash. The car accident took place on a Wednesday night along Highway 180. Sadly, these types of car accidents can happen due to the negligence of a motorist, but this is rounds for litigation in the Golden State.

According to police, a car was going north along a street at a little past 10 p.m. All of a sudden, the car reportedly crashed into a pickup truck on Highway 180. Authorities were not certain which driver neglected to come to a halt at the intersection’s traffic signal.

Sadly, the driver of the car was pronounced deceased at the crash scene. Meanwhile, the driver of the pickup truck was taken to the hospital. His medical condition was not immediately known following the two-car crash.

On the one hand, authorities may discover through their investigation that the pickup truck driver caused the crash due to negligent driving. In this case, the loved ones of the deceased car driver may choose to file a wrongful death claim against the truck driver, seeking damages. On the other hand, police might determine that the car driver caused the accident due to careless behavior behind the wheel. In this situation, the injured pickup truck driver may file a personal injury claim against the deceased car driver’s estate and anyone else with an ownership interest in the car.

Liability must be established before the California court hearing the wrongful death claim or personal injury claim before claims for damages will be decided. A successfully litigated claim might lead to financial damages to address medical bills or funeral costs. Damages may also help with addressing pain and suffering or emotional distress resulting from these types of car accidents.
